    The Health and Safety (Sharp Instruments in Healthcare) Regulations 2013 aimed to: minimise burdens on public, independent and third sector employers and ensure businesses in UK are not placed at competitive disadvantage relative to EU counterparts offer good standards of protection to healthcare workers from risk of sharps injury at work see a fall in sharps injury numbers. This post implementation review (PIR) aimed to assess the success of these objectives. It found that: stakeholder consultation provided evidence of the increasing use of safer sharps across all healthcare sectors. evidence from RCN research and HSE inspections indicates that risks to healthcare workers from sharps injuries remains high. The policy conclusion from this evidence is that the Regulations are still required, and that the Regulations’ objectives cannot be met with a system that imposes less burden to business.

    Conduct guidelines for UK doctors are being updated to spell out what constitutes workplace sexual harassment, amid concerns abuse is going unchallenged. The General Medical Council, which regulates doctors to ensure they are safe and fit to care for patients, says it is adopting a zero-tolerance policy. The new advice explains it is not just physical acts that can be a breach. Verbal and written comments or sharing images with a colleague count too. The new guidance will not come into effect until the end of January, after a five-month familiarisation period for staff. And some say there is still a long way to go. Dr Chelcie Jewitt, an emergency-medicine doctor who is part of the Surviving in Scrubs campaign group, which aims to raise awareness of sexism, harassment and sexual assault in the healthcare workforce, said: "We have spoken with the GMC about the guidelines and we do think that they are a step in the right direction - but there is still a long way to go on this journey to eradicating the culture of sexual misconduct within healthcare. "The GMC has the potential to make a real difference and we need to see them supporting victims when they report perpetrators. "We need their reporting processes to be transparent and clearly explained to victims. "We need cases to be thoroughly investigated rather than dismissed. "And we need appropriate, proportionate sanctioning of perpetrators."     My last blog, "Forgotten heroes" – the sequel, built upon a very moving BBC Panorama programme Forgotten heroes of the Covid front line. The BBC documentary told the sad story of healthcare workers (HCWs) who had bravely and knowingly put themselves in harm's way to care for their patients during the darkest days of the pandemic. Many lost their lives, while many more were rendered so severely injured by the disease (Long Covid) that they were (and remain) unable to work and have been unceremoniously sacked by their NHS Health Trusts/Boards. The way that an organisation manages its activities is known as 'governance'. Good governance will lead to high standards of ethics, morality, care and compassion for the people who work within it and those who may be affected by its acts and omissions. Hence, when applied to a whole country, it is known as 'Government', its departments and agencies. In this blog, I propose a possible hypothetical scenario that may have led to the tragic situation revealed by the BBC documentary. I hope this will lead you to consider the standards of 'governance' that apply to the 'duty of care' which a Government owes to its HCWs during a pandemic and what, morally and ethically, should be done to support those "forgotten heroes" if the Government’s governance should be found to be severely lacking. But is the scenario I am asking you to imagine hypothetical or is it real? I shall leave that to your judgement – and that of the Covid-19 Public Inquiry.

    According to the last AHPRA Medical Training Survey, a third of doctors in training in the USA had experienced or witnessed bullying, harassment or discrimination in the workplace. The person responsible was usually a colleague and concerningly, only a third of those who witnessed or experienced this behaviour reported it. In this article, Josh Inglis explains why we can’t continue to overlook unprofessional behaviour in our workplace, because doing so is causing harm to ourselves, our patients and the profession, and what we can do about it.

    Employee investigations refers to the investigation of allegations made by and against staff. Aneurin Bevan University Health Board (ABUHB) is responsible for the planning, delivery, and commissioning of NHS Wales services for a population of over 660,000 citizens. It employs over 15,000 staff. ABUHB started a programme of work to improve its employee investigations because its HR team identified that during a 15-month period, over 50% of investigations had led to no sanctions for individuals who had been taken through them. Their Employee Wellbeing Service had been concerned about the number of clients who had experienced significant stress and trauma as a result of going through the employee investigation process. The focus of the intervention was to reduce ‘avoidable employee harm’ by reducing the number of employees subjected to investigations, and to reduce the duration of investigations that take place. Andrew Cooper and Liz Rogers from ABUHB will present the case study and report back on the intervention outcomes, key learning points and progress made to date.     Understanding of the significance of psychological safety has grown over recent years as we see the implications of people not speaking out—a culture that forces people to conceal rather than reveal. Concealing observations, ideas and thoughts can lead to major events that are harmful to organisations as much as individuals. Sometimes, individuals feel it is imperative to speak out somewhere, which leads to whistleblowing. This article looks at how to identify whether a workplace has a psychologically safe culture and how to transform cultures where staff don't feel able to speak up.     As reported recently, the Scottish Healthcare Workers Coalition called upon the Scottish Government to reinstate 'universal masking' in health and social care settings.  In this statement written in support of their campaign, an occupational safety and health practitioner, David Osborn, explains the legal requirements for risk assessments that the Government ought to have undertaken before reaching such a decision that exposes healthcare staff to the life-changing consequences associated with repeat Covid-19 infections.  He also explains the legal duty of the Government to consult with workers before implementing changes that may affect their health and safety. Neither duty (risk assessment nor prior consultation with workers) appears to have been well met, putting the Scottish Government and Health Boards in breach of UK-wide health and safety law.

    Doctors have warned the decision to remove face mask guidance in healthcare settings is "playing Russian roulette" with staff and patients' welfare. It was withdrawn in May in hospitals, dentists and GP surgeries having been in place since June 2020. Doctors from the British Medical Association (BMA) Scotland condemned the decision at the time. Now, the Scottish Healthcare Workers Coalition has written to ministers to highlight the "very serious flaws" in changing the guidance. The group is made up of Scottish healthcare workers who worked throughout the pandemic and are now living with long Covid or another chronic post-viral illness or disability. In the letter, the coalition states the updated guidance is not based on the science of coronavirus transmission and "represents a flawed and dangerous decision which will result in more infection in health and social care settings". Dr Shaun Peter Qureshi, of the Scottish Healthcare Workers Coalition, said: "At-risk patients have entirely legitimate concerns that they may endanger their health by visiting their GP or hospital. "With at least 4% of NHS staff now living with chronic post-Covid complications, the Scottish government must follow the evidence and improve protections from the airborne spread (of the virus) in healthcare settings, not reduce them."     A former breast cancer surgeon has said the NHS needs a MeToo movement because of sexual harassment in hospitals. Dr Liz O'Riordan said she experienced sexual harassment from colleagues on a weekly to monthly basis in some of her jobs as a junior doctor. In her first week as a junior doctor, she recalled a colleague asking if she "got an erection" after removing an 11-year-old boy's appendix. "We need to be able to say this is not good enough," said Dr O'Riordan. "When you are a trainee in a practical field, you are relying on your boss to let you operate to show you how to cut; it is a craft that you learn." "Basically you are naked in scrubs stood from shoulder, to hip, to knee, next to someone all squeezed in; a lot of body contact; you are relying on them to let you cut, and if you call them out they may say 'I don't like you, you are not coming to theatre today'. "It's very, very, very hard to stand up for yourself and say 'that is not on' and the minute you let them get away with it, it is accepted and they can carry on getting away with it."     GP trainers are more at risk of burnout than the average for all specialties, according to the GMC’s annual training survey results. The survey of over 70,000 doctors who are trainees or trainers found that 15% of GP trainers are at high risk of burnout, which is higher than the average of 12% and ranked second only to emergency medicine at 24%. The results also showed that 24% of GP trainers said that every working hour is tiring for them, compared to 11% of public health trainers. Last month, GP leaders raised concerns about how trainers and experienced GPs will handle the long-term workforce plan’s expansion of training places, especially given the existing pressures and lack of retention measures.     A struggling trust has been warned by regulators that it could see its junior doctors removed, after concerns about clinical supervision and safety at a hospital whose A&E closes at night. NHS England inspectors who visited Cheltenham General Hospital found emergency patients – including potential surgical patients – became the responsibility of the overnight medical team when its accident and emergency closed in the evening. One night, 26 patients had been handed across, the inspectors were told, and some patients were felt to be inappropriate for medical referral. A surgical registrar could be telephoned at Gloucester Royal Hospital about surgical patients. They were told that although there were no incidents of serious harm, there had been many “near misses” and juniors felt “unsafe and unsupported in terms of consultant clinical supervision, overall clinical/nursing staffing support or logistically in managing patients in this setting or arranging transfers”.     NHS England has issued a ‘tokenistic’ and ‘insulting’ funding settlement for staff mental health and wellbeing hubs this year, which is not enough to provide proper support, HSJ has been told. A letter sent by NHSE to its regional directors, and seen by HSJ, confirmed that the hubs have been allocated just £2.3m for 2023-24. NHSE says the funding, which is far below current running costs, must be spent within the financial year. It appears to confirm fears that many of the 40 hubs will need to be shut, if they are not funded locally. One hub lead said: “Day in, day out, we work with colleagues across the NHS who are struggling with a wide range of mental health issues, from anxiety and depression to burnout and dealing with the impacts of moral injury. “Staff are exhausted, overwhelmed by their workload and struggling to give their patients the care they know they deserve. “I urge ministers to speak directly to hub leads to find out exactly what the issues are on the ground, and how the hubs are helping staff who are working at their limits, while supporting staff retention.” Read full story (paywalled) Source: HSJ, 6 July 2023

    Britain’s lead public health body has a staggering lack of control over billions of pounds of spending, and there is no plan for stockpiling vaccines or personal protective equipment (PPE) for a future pandemic, a damning MPs’ report has found. The public accounts committee was highly critical of the repeated governance and financial failings at the UK Health Security Agency (UKHSA), which was set up with great fanfare under Boris Johnson. Meg Hillier, the committee chair, said it would be “utterly inexcusable” for the government to have failed to make serious preparations for future health emergencies and warned the lack of a plan for stockpiling could leave health workers once again exposed to danger as they were in 2020. The committee lambasted the Department of Health and Social Care (DHSC), which oversees UKHSA, for lacking a strategy for reserves of PPE, vaccines and medicines despite its mandate to protect the country’s health security.     A "significant" number of doctors are still suffering with the "debilitating effects" of Long Covid, according to a new report. Many are left in financial limbo as they have been forced to quit work or reduce their hours, the British Medical Association (BMA) report warns. Some 600 doctors with long COVID were quizzed about the impact on their day-to-day lives. One in five told the BMA and the Long COVID Doctors for Action group they had been forced to stop work or significantly cut back on their hours. Carrying out essential daily activities such as getting dressed, household activities, and childcare have become difficult or not possible for 60% of the medics who took part in the survey. Nearly half (49%) said they have experienced loss of earnings as a result of Long Covid symptoms of which include: fatigue, headaches, muscular pain, nerve damage, joint pain, ongoing respiratory problems. The BMA has made a series of calls to support doctors with Long Covid, including: Financial support for doctors and other health workers with Long Covid. Long Covid to be recognised as an "occupational disease". Better access to physical and mental health services for those affected after the report said that access to NHS long COVID clinics is "patchy". Greater "workplace protection" for staff.
