	The regulators will have new powers to use a less adversarial and quicker ‘accepted outcomes’ process for dealing with complaints about healthcare professionals. PSA accepted outcomes guidance: 
</p>

<ul>
	<li>
		provides pointers to help regulators decide when a case can be resolved without a public hearing
	</li>
	<li>
		advises on when a hearing might be needed to maintain public confidence and ensure a robust review of the evidence
	</li>
	<li>
		helps regulators decide who should make the final decision on a case when not referring it to a hearing
	</li>
	<li>
		helps regulators decide what information to include when publishing decisions.    
	</li>
</ul>

<p>
	The regulators will also have new powers to make and amend the rules governing the way they regulate. The rulemaking guidance:  
</p>

<ul>
	<li>
		lays out principles to guide regulators to use their powers transparently, with appropriate consultation and in a way which prioritises public protection 
	</li>
	<li>
		encourages regulators to consider how their use of these powers aligns with the practice of other professional regulators, as appropriate.
	</li>

	Key points
</h4>

<ul>
	<li>
		HSSIB’s safety investigations will have legal privilege, also often referred to as ‘safe space’. This means that its investigation evidence and findings are subject to special protections. They cannot be disclosed without the HSSIB chief investigator’s consent, or without a High Court order that has assessed the public benefit of that disclosure.
	</li>
	<li>
		HSSIB will not need to obtain prior patient or family consent to speak to staff and capture the details of what happened during an incident.
	</li>
	<li>
		HSSIB will have the power to require staff to speak to its investigators.
	</li>
	<li>
		HSSIB investigators will have the authority to enter healthcare premises, inspect any equipment or documents and take copies or remove any item as long as doing so does not pose a risk to the safety of any patient.
	</li>
	<li>
		HSSIB’s powers will extend to investigations for care received in private and independent healthcare providers.
	</li>
	<li>
		After April 2023, maternity investigations will continue with a new body—the Maternity and Newborn Safety Investigations special health authority (MNSI), which will have a separate remit and powers to HSSIB.
	</li>

	During 2021-22, the impact of the Covid-19 pandemic continued to put intense pressure on healthcare services and required HIW to adapt its processes and approach to its work. This report outlines how HIW introduced new ways of working to ensure it discharged its statutory functions, whilst being as flexible and adaptable as possible to avoid putting undue pressure on health services. The report describes HIW's progress against its four strategic priorities:

	This mapping revealed over 126 organisations who exert some regulatory influence on NHS provider organisations in addition to 211 Clinical Commissioning Groups. The majority of these organisations set standards and collect data from provider organisations and a considerable number carry out investigations. The variability in approach and overlapping functions suggest that there is no overall integrated regulatory approach.
